Mental capacity is the ability to make an informed decision
Let’s talk about mental capacity! Because you have a speech, language or communication need (SLCN) as a result of an acquired or progressive neurological condition , does NOT mean you don’t have capacity.
Mental capacity is time and decision-specific. Some people will be able to make certain decisions e.g. what they would like to drink (tea or coffee) but not others (discharge destination after hospital). Some people may need support in providing information in a different way that helps them better understand the information given about a decision (total communication approach). Some people may not be able to express their wishes using speech but indicate via other means (AAC- Augmentative and alternative communication) e.g. pointing to pictures/written words or writing. And remember a person’s mental capacity may change over time
How can a Speech and Language Therapists help with mental capacity assessments?
I advocate for my clients by using my expertise in communication assessment & facilitation to ensure that they receive the specific support they need to understand, think and talk about decisions during mental capacity assessments. I use my specialist skills to support my clients to understand and engage in advance care planning.⠀
I advocate for my clients, when a decision is made in her/his best interests. This involves explaining my clients preferences and views about different decision options to the people making the best interest decision.⠀⠀⠀
⠀⠀⠀⠀⠀
I educate professionals, service users and their families about the types of support people with Speech, Language & Communication Needs (SLCN) may require to make decisions and demonstrate their mental capacity.
I train other people to use communication strategies and techniques to support people with SLCN when they make decisions or during mental capacity assessments.
How do you know if someone has mental capacity?
1. Does the person understand the information given?
2. Are they able to retain the information?
3. Are they able to think about the decision options and weigh these up ( pros and cons) to make a decision
4. Are they able to communicate their decision ( doesn’t need to be speech, it can be using any forms of AAC)
What do mental capacity assessments tell us?
They indicate whether the individual can make the decision independently, with support, or needs others to make it on her/his behalf, in her/his “best interests”.
